Terms of Use

1. Agreement

These Terms of Use ("Terms") govern your use of the Surf Crew mobile application ("the App"). By creating an account or using the App you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

You must be at least 13 years old to use the App.

2. What the App Is

Surf Crew lets private groups of surfers ("crews") share short surf reports with each other. Reports are written by members, not by us. They are opinions about conditions at a moment in time and are hidden after 4 hours. We do not verify them.

3. Your Account

• You are responsible for keeping your password private and for everything done with your account.
• You must give a display name that does not impersonate another person.
• You can delete your account at any time from Settings in the App.

4. Content You Post

You own the surf reports and notes you post. By posting them you give us a licence to store and show them to the members of the crew you posted to, which is all we do with them.

There is no tolerance for objectionable content or abusive behaviour. You must not post content that is:

• Harassing, threatening, hateful or discriminatory
• Sexually explicit, violent or otherwise offensive
• Illegal, or that encourages illegal activity
• Spam, advertising, or content that impersonates someone else
• Personal information about another person without their consent

Every report has a Report option. We review every content report within 24 hours and remove content that breaks these Terms. Accounts that break them are removed. You can also Block any member; you will never see their reports again.

5. Crews and Invite Codes

Anyone with a crew's invite code can join that crew. Share codes only with people you trust. Crew admins can remove members. Members can leave a crew at any time.

6. Surf Safety

Surfing is dangerous. Reports in the App are personal opinions and can be wrong, out of date, or about a different part of the beach. Always check conditions yourself before entering the water. We are not responsible for any injury, loss or damage arising from your reliance on a report.

7. Availability and Changes

The App is provided as is. We may change, suspend or stop the App or any feature at any time, and we may update these Terms. Continued use after a change means you accept the updated Terms.

8. Termination

We may suspend or delete accounts that break these Terms, without notice. You may stop using the App and delete your account at any time.

9. Liability

To the fullest extent permitted by the Australian Consumer Law and other applicable law, we exclude all liability for any loss or damage arising from your use of the App. Nothing in these Terms excludes rights you have under law that cannot be excluded.

10. Governing Law

These Terms are governed by the laws of Victoria, Australia.
